Legal and Constitutional Unit

CPA submitted a Discussion Paper to the Reconstruction and Development Agency (RADA) on Reflections on Tsunami One Year on: Lessons to be Learnt. This was to provide policy makers and stakeholders with a document taking stock of what has taken place that will assist in the formulation of policies and plans in rehabilitation, reconstruction and development efforts in relation to both the conflict and tsunami. An Executive Summary and CPA Recommendations are also available.

A study commissioned by the International Federation of Red Cross and Red Crescent Societies, to better understand the problems of landlessness and homelessness in Sri Lanka, so that assistance provided by donor agencies in the post-tsunami recovery and reconstruction process may be more targeted and effective. The study looks at both pre-existing land and housing policies, as well those policies formulated to deal with housing loss and damage following the tsunami. A study profiling the stigma and discrimination faced by people living with HIV/AIDS and their family members was launched on the 5th of December 2005. Parliament passed a resolution approving the declaration of a state of emergency on Friday the 11th of February 2005. The concerns with regard to the declaration of emergency ostensibly to facilitate post-tsunami reconstruction is addressed in this article. Mandate, Process and an Interim Constitution as Modus Vivendi is an article by Asanga Welikala, Research Associate, Legal & Constitutional Unit, on the recent debate on the abolition of the executive presidency and the extra-constitutional modalities for constitutional change. The article first appeared in the author’s column in the Daily Mirror newspaper of 6th and 13th March 2004.

The Centre for Policy Alternatives (CPA) intervened on the question of the scope of the Supreme Court’s consultative jurisdiction under Article 129 of the Constitution. The question arose in the case of the President’s reference to the court regarding the Inland Revenue Act No. 10 of 2003 (The Tax Amnesty Reference). This short-term study aims at identifying the main land and property issues currently emerging in the North East and at providing principled and practical recommendations to relevant decision makers to address challenges regarding land and property, resettlement, relocation, rebuilding and restoration of normalcy in the region.

Conflict and Peace Analysis Unit

The Centre for Policy Alternatives (CPA) has been engaged in a project "Monitoring the Factors Affecting the Peace Process" to assess the current status of the peace process. This project involves 4 of CPA's units and the Point Pedro Institute for Development, which looks at economics issues. Looking at developments within a quarterly period, this project produces reports for the corresponding periods.

A number of key factors, that impact the peace process, have been monitored to observe trends of change or stasis. The factors have been grouped into a series of clusters which reflect critical dimensions of the peace process. The trends will suggest the level of change in each cluster and in sum will indicate how the peace process and its environment have been strengthened or weakened. Trends observed in each of the various clusters and factors are carried in the Cluster Report while the Synthesis Report analyses change and statsis in the clusters in sum. CPA organised a conference from 8th to 9th July 2005 on the International Dimensions of the Sri Lankan Peace Process and on the role and impact of the international community in the current peace process. Given that the peace process is “internationalised”, the conference attempted to widen the debate on how internationalisation could be evaluated and strengthened if necessary. Sri Lanka's Ethnic Problem and Solutions

This booklet presents much useful information on the history of the ethnic problem in a simple attractive and succinct manner. It points clearly and with evidence the way the Sinhala majority leaders failed to remedy the substantial grievances of the Tamil people of this country. While doing to it also highlights the need of a political solution based on the devolution of power.

Informal Dispute Resolution in
The North East and Puttalam

Informal dispute resolution seemingly offers many advantages over formal means of redress. In particular, it is more flexible than the judicial system and can tackle issues which may be addressed by formal mechanisms.

This study, commissioned under UNHCR's 'Peaceful Co-existence Initiative', was conceived to identify existing mediation and informal dispute resolution mechanism at the local level, which may assist in the reintegration and reconciliation of local communities.

After nearly two decades of strife and in the context of the on going truce between the Sri Lankan Government and the LTTE, the people of Jaffna have been placed in the spotlight, receiving more national and international attention than before. On the eve of rebuilding Jaffna, Social Indicator (SI), the Polling Unit of CPA, initiated a series of surveys to ascertain the opinion of the people of Jaffna. Media Charter

Part of Voices of Reconciliation project, this charter sets out the minimum standards and principles that underpin the public's right to know and a free media in a democratic society and outlines a practical program of action to support media reform. “On the Road to Peace” is an International Federation of Journalists (IFJ) project on conflict reporting in Sri Lanka. The report (available in English, Sinhala and Tamil) of the United States Institute of Peace-supported IFJ conflict reporting project conducted in association with the CPA Media Unit, includes findings of research into journalists’ attitudes on and experiences of reporting conflict, including case studies. A pamphlet on Conflict Reporting based on key findings of the study is also available in Sinhala and Tamil languages

Study Report on media coverage of key issues related to the Peace Process, the Cease Fire Agreement and the ‘Post-Tsunami’ environment for the month of March 2005.

The CPA Media Unit supported by International Media Support (IMS) of Copenhagen, Denmark, undertook A Study of Media in Sri Lanka (excluding North and East) in order to identify capacity and constraints faced by Sri Lankan mainstream and regional media, in the creation and consolidation of democratic laws and practices, and a culture of tolerance and diversity.

 

A handbook (including extracts from the IFJ and RSF handbooks) on Safety for Journalists reporting in conflict environments was recently published in the Sinhala and Tamil languages by the CPA Media Unit.

In its efforts to promote responsible, accurate and unbiased reporting, particularly during the critical elections the country faced on 2nd April 2004, the Centre for Policy Alternatives (CPA) monitored election related coverage by state and non-state print and electronic media of all three language streams, covering the period 17th February 2004 to 1st April 2004. Monitoring and analysis of election coverage by four Jaffna based newspapers, along with a qualitative analysis of the advertisement campaigns carried out by various political parties during the election period was part of this study.
